Description

One of the effects of climate change is the presence of natural calamities in the form of floods and droughts. They directly impact on water resources. Floods and droughts strongly affect the environment and the people inhabiting it - their health and lives. Mankind is trying to deal with droughts and floods on many levels, including the legal field. Using a dogmatic method, I would like to analyse the legal solutions to droughts and floods adopted at international, EU and national level.
By beginning by defining the terms drought and flood, moving on to the causes of these natural calamities and then to their effects, I would like to focus on the legal science preventive measures concerning them.
From the field of international law, I will mainly examine the United Nations' the 2030 Agenda for Sustainable Development. In the law of the European Union, the EU Biodiversity Strategy for 2030 and the proposed Nature Restoration Law seem to be worth analysing in particular. In the last proposal, the issue of peatlands and wetlands, which is to have an impact on agriculture and water resources, seems interesting. It is being discussed not only at EU level, but also in the public, whose reactions to these proposals are surprising negatively. From the national legal field, I will refer to the Polish legal order implementing these solutions.
Are the proposed legal solutions adequate to achieve the stated objective? Are they a tool to actively implement concrete solutions? I will answer these questions in my presentation.
While solutions at the international level provide a guideline for action against these disasters, it is difficult to find concrete solutions. The legal norms of EU law are already an active legal tool, defining concrete obligations. They are only made more specific in national law.
Unfortunately, the implementation of these solutions is causing resistance from the public. This challenge cannot be dealt with by the law alone. Creating a healthy environment is indeed an interdisciplinary challenge.
